Any reference to the Kentucky Derby is owned by CDI. If they expect to use any footage, naming references, etc. in promotion, they will presumably need to broker a deal to do so. You can't reference the Super Bowl or anything related to it in advertising without expressed consent and permission from the NFL - this is no different.
Considering the fact that they haven't exactly endeared themselves to CDI, by calling them out on national TV...just saying....Would you put it past 'em?
