I'm pretty sure it's 9%, and that goes to the purse.

Horses that are not nominated to Breeders' Cup
If a Horse of Racing Age nomination is not paid prior to or at Pre-Entry, the horse may be supplemented to a Championship race. The total supplementary fee is 9% of the guaranteed purse if the sire was nominated to the Breeders' Cup, European Breeders' fund or the BCL/EBF Common Fund program when the horse was conceived or 15% of the guaranteed purse if the sire and horse were not nominated. One-third (1/3) of the Supplementary fee is due at pre-entry on October 25, 2010. The remaining two-thirds (2/3) is due to pass the box at the time of entry closing, November 2, 2010 as designated by the host track.
Note: Payment of supplementary pre-entry and entry fees will make a horse eligible only for a specific Breeders' Cup Championship race. Payment of such fees will not make the horse eligible to any other Breeders' Cup purse or awards program.
Refunds for Pre-Entry, Entry and Supplementary Fees
Pre-entry fees and entry fees for nominated horses are non-refundable except in the event of sickness or disability certified by the track or state veterinarian (or veterinary certification acceptable to Breeders' Cup Limited) or in the event a horse is prevented from starting by a decision of the Racing Directors/Secretaries Panel in order to limit the field of starters. The first one-third (1/3) of the supplementary fee is non-refundable except in the event a horse is prevented from starting by decision of the Racing Directors/Secretaries Panel in order to limit the field of starters. The remaining two-thirds (2/3) of this fee is non-refundable except in the event of sickness or disability certified by the track or state veterinarian (or veterinary certification acceptable to Breeders' Cup Limited) or in the event a horse is prevented from starting by a decision of the Racing Directors/Secretaries Panel in order to limit the field of starters.
Supplementary Fee Credit
Non-nominated horses that are supplementary entries will receive a credit in an amount equal to the supplementary fees paid (less that portion allocated to pre-entry and/or entry fees) in all subsequent year in which the non-nominated horses are supplementary entries in Championship races. The credit may not be utilized to reduce that portion of supplementary fees allocated to pre-entry and/or entry fees but shall be credit against the remaining portion of the supplementary fees.
