Default OH Speeding Ticket controversy for me!!!

So driving to work this morning and for those that know Higgins Road in Schaumburg, there is a stretch through some woods where you go pretty fast. I got pulled over by a sheriff saying I was going 64 in a 45. Now, I would almost guarantee I was probably going faster then that, but the guy was like "I have to give you a ticket but I will give you a court diversion slip" So I automatically am thinking that he doesn't want to go to court. When he comes back with the ticket, I ask "Can I please see the radar gun" he says "It is already cleared". I say "Ok" and that is that. Now, there is NO WAY that he got me on the gun given he was going the other way down Higgins, and there is no way that he could have paced me because he was going the other way?

Anyone know if there is a protocol in radar gun clearing? I am going to contest it and go to court, not only will he probably not show up, but after that I think I have a decent case.

I wonder how much this is worth to him...your public and free will posting of your guilt beyond a reasonable doubt?

Where was that.in the forest preserve before the 53 intersection?

Yeah.....I just noticed some flaws also

1) He didn't ask for me to even sign the ticket
2) He didn't fully describe the Illinois Vehicle Code (Just put 11-601 (B), missing (01,03,05,07) on the end)

Court is also at SKOKIE, not Palatine

next time you're there, check out the speed limit posting..I looked once and there aren't many signs..maybe not from between when you turn off of AH Rd onto Higgins and when he pulled you over?

You admit you were well over the speed limit....and being a clear and present danger to fellow incompetents on the highway.

The guy didn't stop you for 47. He stopped you for 65---which you admit was a little on the low side.

Sir, because he has zero proof, and I have a prestine record. That alone will get me at maximum a fine. And when he doesn't show up, it costs me nothing and I get a day off of work.

couple things....first, in traffic court nobody cares about proof, the police officer is considered a professional witness in the eyes of the law and his word will carry more weight than yours.
second....don't they give officers a mandatory day in court in illinois like most other states? they get paid to be there so there isn't any chance of a no-show.
third...it's pristine, and how will a clean record get you a maximum fine?
as I understand it, as long as the radar gun is calibrated before each shift (and they document that it has been) they don't have to show you sh*t....I've seen my fair share of traffic court.

I'm with Morty on this one. Why bother? If you think he actually got you on the low side don't fight it.

I got a ticket in California a couple months ago going 89 in a 65, when in fact I was probably going over 100. In California if you're going 25+ they can put you in jail immediately. I said thank you sir have a nice day and paid it.

I have rethought it and I am waiting on response from a friend on options, but i am probably just going to suffer through the 4 hour traffic school and have it not go on my record, $115.....

Just kick the cop in the balls and drive off next time. Cheaper than going to court for it.

I don't know how he could have gunned you if he was driving the other way. So wouldn't the judge have to ask where he got the 64mph figure from?
What's the worse that could happen, you are guilty and have to pay a fine for doing 64. That's what you are thinking about doing anyway. It seems like a freeroll. Unless Morty rats on you.

good luck with the ticket, scav. my advice would be to plead guilty and try to get traffic school. no big deal for a young guy like yourself. and i apologize for being a small part af the hijacking of this thread, but it is fun messing with the legend that is mortimer.
