I'm curious why the daughter in this story decided not to contest it and whether the brothers agreed with the father's wishes or not.

John Steinbeck's heirs fought for decades with his widow over the rights to his books. It was still going on as of just a year or so ago, I think (now with her estate as she died years ago).

she must not be too concerned about it. my husband may be a victim of 'martin chuzzlewhit' behavior from his folks-if he doesn't get a tiny piece of their tiny pie, we won't care. it would be par for the course from them.

i don't like seeing things like this, tho, when there seemingly was no friction-it can cause a TON of problems for the survivors, with resentment, ill-feelings and the like.
the dead dad-he's the reason they have issues, and he hasn't got to deal with any of it.


and with more blended families, and half-siblings and stepwives, i expect more litigation in future.

i just set up a trust (it's not just for rich people) and in california they come with boilerplate language that excludes any heir (technically a successor trustee) who contests the provisions of the trust.

that doesn't put any kind of barrier up to anyone who is completely excluded but it should give pause to anyone you name to receive say 10% who thinks they should have gotten more.
