DOJ revises position on Wire Act/Internet Gaming
Department Of Justice Flip-Flops On Internet Gambling
On the Friday before the Christmas weekend, the Department of Justice revealed that it had changed one of its most important and long-held positions on Internet gambling, stating that the federal Wire Act of 1961 only applies to sports betting. The new position on the Wire Act marks a huge shift for the Justice Department, which has long relied on the law when asserting that all forms of Internet gambling, especially online poker, is illegal.

Would like to hear from tector and other legal eagles as to the implications.
Clear the way for lotteries but that poker, et al, remain illegal but due to the Unlawful Internet Gambling Enforcement Act as opposed to the Wire Act. That would seems to say that the only thing preventing wider online casino activities is the repeal of the Unlawful Internet Gambling Enforcement Act.. Is that a fair reading?

This is pretty significant. Horse racing has enjoyed a blue ocean when it comes to online gaming. I expected movement in this area in Obamas second term but regardless, it's a fairly aggressive interpretation and one which opens the door for a significant amount of online gaming. It's probably no coincidence that it follows a few months after the big poker breakdown.

Wire act purpose was to control and eliminate bookmaking statute was narrowly drafted and should be strictly construed
To extend its reach to Internet gambling and poker was at best a tortured interpretation My great governor never misses an opportunity to headline cash and states that CT will be looking at ways to allow online gambling including poker Now if he only channel that fervor toward rebuilding the manufacturing base that once made this state great

Steve, I think you are basically right. But of course if you get a "new" Justice Dept. in 13 months, you might get a new interpretation.
What needs to happen is that Congress needs to act like adults--adults interested in stimulating the economy and producing revenue--and have a comprehensive overhaul/modernization of all the laws affecting interstate gaming. Wanna bet on it?
