Default deen-race suit tossed

http://news.msn.com/pop-culture/race...a-deen-lawsuit

i didn't realize the claimant was white....BUT, the former employee was suing for sex harrassment, and working in a racist environment. she had to personally be a different race for it to bother her?! i disagree! i cannot stand to have people use racial slurs, and they learn very quickly i do not wish to hear them, don't condone them.
using slurs is using slurs....i don't agree with the judges ruling. you don't have to be black to be appalled and uncomfortable to hear the N word.

I agree, but legally she can't claim that she was being discriminated against. (It's only the racial discrimination part that was tossed; the allegations of sexual discrimination can still go forward.) From the ruling:

"While Plaintiff may have faced significant challenges in managing a workplace allegedly permeated with racial discrimination, her difficulties do not fall within the zone of interests sought to be protected by Title VII [of the Civil Rights Act of 1964] and cannot support a claim for racial discrimination under that stature."

I read the entire complaint, and there's still PLENTY in there to go forward.

Whether any of the black employees will decide to sue is the question- there's a statute of limitations issue, I think. But if you haven't read the NY Times piece about the woman who was Deen's head chef, I highly recommend.

I think she alleged she was more affected by it than an average caucasian on account of having bi-racial nieces. Which is really reaching, I think. Again, not saying it didn't make for a miserable working environment, but her own civil rights were not being violated because of racial discrimination against other employees. Here's the PDF of the complaint. I literally said, "OH MY GOD!" out loud several times while reading it.

The saga starts on page 4.
